1. Overview

Welcome to Auramilk.

These Terms of Service govern your access to and use of www.auramilk.co.nz, including any purchases made through the website.

Throughout these Terms, “Auramilk”, “we”, “us” and “our” refer to Auramilk and the business operating www.auramilk.co.nz. “You” and “your” refer to any person who accesses the website or places an order through it.

By accessing our website, creating an account or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Returns and Refunds Policy.

If you do not agree to these Terms, please do not use the website or place an order.

2. New Zealand Consumer Rights

Nothing in these Terms limits, excludes or modifies any rights or remedies that cannot lawfully be limited or excluded under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable law.

Our products come with guarantees that cannot be excluded under New Zealand consumer law. Products must be of acceptable quality, fit for their intended purpose, match their description and be delivered within the agreed or a reasonable time.

If there is any inconsistency between these Terms and a mandatory right under New Zealand law, the mandatory legal right will apply.

3. Eligibility

To place an order through our website, you must be at least 18 years old or have the consent and supervision of a parent or legal guardian.

By placing an order, you confirm that the information you provide is accurate, current and complete and that you are authorised to use the selected payment method.

4. Website Information

We take reasonable care to ensure that product descriptions, ingredients, images, prices and other website information are accurate.

Product packaging, colours and appearance may vary slightly from images displayed on different devices. We may update product packaging or improve a formulation from time to time, provided that the product supplied continues to match its material description and applicable legal requirements.

The ingredient list printed on the product packaging is the most current ingredient information. If you have an allergy, sensitivity or specific ingredient concern, please review the packaging before use and contact us before purchasing if you require clarification.

We will correct material website errors as soon as reasonably practicable after becoming aware of them.

5. Product Use and Skincare Information

Auramilk products are intended for cosmetic and personal-care use unless otherwise stated on the product label.

Information on our website is provided for general product and skincare information. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease or medical condition.

Always follow the directions and warnings on the product packaging. We recommend performing a patch test before using a new skincare product.

Discontinue use if irritation or discomfort occurs. Seek advice from an appropriate healthcare professional if you have a medical condition, a serious reaction or concerns about whether a product is suitable for you.

Individual skin types and results vary. Nothing in these Terms excludes responsibility where a product is unsafe, faulty, contaminated, incorrectly described or otherwise fails to meet a guarantee under applicable consumer law.

6. Orders and Contract Formation

Submitting an order is an offer to purchase the selected products.

After you place an order, you may receive an automated email confirming that we have received it. This acknowledgement does not necessarily mean that the order has been accepted.

An order is accepted when we confirm that it has been processed or dispatched. We reserve the right to decline or cancel an order before acceptance for legitimate reasons, including:

A product being unavailable;
An obvious pricing or product-information error;
Payment not being authorised;
Suspected fraud or unauthorised activity;
Delivery being unavailable to the supplied address; or
The order exceeding a stated purchase limit.

If we cancel an order after payment has been taken, we will refund the affected amount to the original payment method as soon as reasonably practicable.

We will not decline or cancel an order for a reason prohibited by law.

7. Product Availability and Purchase Limits

Products are subject to availability.

We make reasonable efforts to keep stock information accurate, but a product may occasionally become unavailable after an order is submitted.

We may apply reasonable quantity limits to products or promotions to maintain availability, prevent unauthorised resale or address suspected fraudulent activity. Any material purchase limit will be disclosed where reasonably practicable.

We will not advertise products as available unless we have a reasonable basis for believing that we can supply them on the stated terms.

8. Prices, GST and Payment

Unless stated otherwise:

All prices are in New Zealand dollars;
Prices include New Zealand GST where applicable; and
Delivery charges are calculated and displayed during checkout before payment is completed.

You are responsible for reviewing the total price, delivery charge and order details before completing checkout.

We may change prices at any time, but a price change will not affect an order that we have already accepted, except where correction is required by law or an obvious error occurred and we contact you before accepting the order.

Payment must be completed using one of the payment methods displayed at checkout. Payment processing may be provided by Shopify or another third-party payment provider and may be subject to that provider’s terms and privacy practices.

We do not guarantee that every payment method will always be available.

9. Promotions and Discount Codes

Promotions and discount codes are subject to the terms displayed with the applicable offer.

Unless otherwise stated:

Only one discount code may be used per order;
Discount codes cannot be exchanged for cash;
Discount codes cannot be applied after an order has been placed;
Promotions are available while stocks last;
Promotions cannot be combined with other offers; and
Delivery charges do not count toward a minimum purchase amount unless expressly stated.

We may correct, suspend or withdraw a promotion where there is an error, fraud, misuse or another legitimate reason. We will not misrepresent savings, usual prices or product availability.

10. Delivery

Delivery areas, estimated timeframes, charges and any free-delivery thresholds are described in our Shipping Policy and at checkout.

Delivery timeframes are estimates unless we expressly agree to a specific delivery date. We will make reasonable efforts to dispatch and deliver orders within the stated timeframe.

You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an address error. We cannot guarantee that an address can be changed after an order has been processed or dispatched.

Risk in the products passes to you when the order is delivered to the address you supplied, subject to your rights under applicable law.

If an order is lost, damaged, delayed or delivered incorrectly, please contact us at hello@auramilk.co.nz so we can investigate and provide any remedy required by law.

Nothing in this section limits your rights where products are not delivered within the agreed or a reasonable time or do not arrive in good condition.

11. Returns, Refunds and Exchanges

Returns, refunds and exchanges are handled in accordance with our Returns and Refunds Policy and applicable New Zealand consumer law.

Change-of-mind returns may be subject to hygiene and product-condition requirements. These discretionary requirements do not limit rights or remedies available for faulty, unsafe, damaged, incorrectly supplied or misdescribed products.

12. Customer Accounts

You may be able to create or access a customer account through our website.

You are responsible for:

Providing accurate account information;
Keeping your login access secure;
Preventing unauthorised access to your account; and
Notifying us promptly if you believe your account has been compromised.

We may suspend or restrict an account where reasonably necessary to address fraud, misuse, security risks or a material breach of these Terms.

13. Acceptable Use

You must not use the website:

For any unlawful, fraudulent or misleading purpose;
To interfere with the website’s security, availability or operation;
To introduce viruses, malicious code or other harmful technology;
To collect information about other users without authorisation;
To impersonate another person or misrepresent your identity;
To infringe intellectual property or privacy rights;
To place fraudulent orders or use an unauthorised payment method;
To scrape, copy or commercially exploit website content without permission; or
To send spam or other unauthorised communications.

We may restrict access to the website where reasonably necessary to protect Auramilk, our customers, our service providers or the security and integrity of the website.

14. Intellectual Property

Unless otherwise stated, all content on this website—including the Auramilk name and branding, product names, photographs, graphics, videos, text, packaging designs, logos and website design—is owned by or licensed to Auramilk and is protected by applicable intellectual property laws.

You may access and use the website for personal, non-commercial shopping purposes.

You must not copy, reproduce, modify, distribute, publish, display, sell, license or commercially exploit website content without our prior written permission, except where permitted by law.

15. Reviews and User-Submitted Content

If you submit a review, photograph, video, comment or other content to us, you confirm that:

The content is truthful and reflects your genuine experience;
You own the content or have permission to submit it;
The content does not infringe another person’s rights;
The content is not unlawful, defamatory, abusive, misleading or obscene; and
The content does not contain confidential information or malicious code.

You grant Auramilk a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and share the submitted content for website, customer-service and marketing purposes, subject to applicable privacy law.

We may moderate or remove submitted content where reasonably necessary, but we will not edit or suppress genuine reviews in a way that creates a misleading impression of customer feedback.

16. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment processors, delivery providers, review platforms and social-media services.

Third-party websites and services are operated independently. Their own terms and privacy policies apply when you use them.

To the extent permitted by law, we are not responsible for third-party content or services that are outside our reasonable control. This does not limit any responsibility that Auramilk has for suppliers or service providers acting on our behalf where the law makes us responsible.

17. Privacy

We collect, use, store and disclose personal information in accordance with our Privacy Policy and applicable New Zealand privacy law.

By using the website or placing an order, you acknowledge that personal information may be processed as necessary to manage orders, payments, delivery, customer service, fraud prevention and other purposes described in our Privacy Policy.

18. Website Availability

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted access.

We may temporarily suspend or restrict parts of the website for maintenance, security, technical problems or circumstances outside our reasonable control.

Where reasonably practicable, we will minimise disruption and restore access promptly.

19. Liability

Nothing in these Terms excludes, restricts or modifies:

Your rights under the Consumer Guarantees Act 1993;
Rights or remedies under the Fair Trading Act 1986;
Liability that cannot lawfully be excluded or limited; or
Liability for fraud, wilful misconduct or personal injury caused by negligence where exclusion is prohibited by law.

Subject to those protections and to the extent permitted by law, Auramilk is not liable for indirect or consequential loss that was not reasonably foreseeable and was not caused by a breach of our legal obligations.

You are responsible for using products in accordance with their directions, warnings and intended purposes. We are not responsible for loss caused solely by misuse, unauthorised alteration, failure to follow product directions or continued use after an adverse reaction becomes apparent.

20. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by events outside our reasonable control, such as natural disasters, severe weather, transport interruption, industrial action, government restrictions, telecommunications failure or widespread supply disruption.

We will take reasonable steps to minimise the impact and communicate material delays.

This section does not limit any right you may have to cancel an order or receive another remedy under applicable law.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products or legal obligations.

The updated version will be published on this page with a revised “Last updated” date.

Changes will apply from the date of publication and will not retrospectively alter an order that we have already accepted, unless required by law or agreed with you.

22. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue to apply.
